Terms of Use

These Terms of Use ("Terms") govern your access to and use of the GatherCam website, iOS app, App Clip, and any other products or services that link to these Terms (collectively, the "Services"). Please read them carefully.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Who may use the Services

You must be at least 18 years old, or the age of legal majority in your jurisdiction (whichever is higher), to use the Services. By accessing or using the Services, you represent that you meet this requirement.

2. Privacy Policy

Our Privacy Policy explains how we collect, use, and share information when you use the Services. By using the Services, you agree to our Privacy Policy.

3. Accounts

Certain features may require you to provide optional information such as your name or email address (for example, so a host can send you an event gallery link). You agree to provide accurate information and to keep it up to date. You are responsible for any activity that occurs in connection with your device or any account you use with the Services.

4. Event hosts and guests

GatherCam is designed around events hosted by one person (the "host") and joined by guests:

• The host creates and controls the event (for example, event name, dates, photo limits, and whether to share the gallery with guests).
• Guests join using the host's event link or QR code and can upload photos or videos while the event is active, subject to host–defined limits.

As a host, you are responsible for how you use and share the gallery and any content captured at your event, including complying with applicable law and respecting the rights of your guests.

5. Your content and rights you grant

When you upload photos, videos, or other content to the Services ("User Content"), you retain ownership of your content. You also grant us and, in some cases, the event host and guests, certain rights so that the Services can function.

• You grant GatherCam a worldwide, non–exclusive, royalty–free, sublicensable license to host, store, process, reproduce, transmit, display, and otherwise use your User Content as reasonably necessary to operate and improve the Services.
• For each event you contribute to, you grant the event host a non–exclusive license to view, download, and share User Content from that event for personal or event–related purposes (for example, sharing a gallery with guests), subject to these Terms and applicable law.
• If the host enables "share gallery with guests" for an event, guests may be allowed to view and download User Content from that event after it ends. You understand and agree that other guests may see your contributions in that shared gallery.

You are responsible for the content you upload and warrant that you have all necessary rights and permissions to grant these licenses.

6. Acceptable use

You agree not to use the Services to:

• violate any applicable law, regulation, or third–party rights;
• upload or share unlawful, defamatory, harassing, hateful, violent, pornographic, or otherwise objectionable content;
• infringe or misappropriate any intellectual property or other proprietary rights;
• attempt to gain unauthorized access to any systems, accounts, or data;
• interfere with or disrupt the integrity or performance of the Services; or
• attempt to circumvent any technical or usage limits we put in place (for example, per–guest photo limits).

We may remove or disable access to content, or suspend or terminate access to the Services, if we reasonably believe these Terms have been violated or the Services or other users are at risk.

7. Our rights in the Services

We and our licensors own all rights, title, and interest in and to the Services, including all software, designs, text, graphics, logos, and other content (excluding User Content). We grant you a limited, non–exclusive, non–transferable, revocable license to use the Services for your personal, non–commercial use, subject to these Terms.

8. Disclaimers and limitation of liability

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non–infringement.

To the fullest extent permitted by law, GatherCam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or relating to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us, if any, for use of the Services during the six months prior to the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).

9. Indemnification

You agree to indemnify and hold harmless GatherCam and its owners, affiliates, and service providers from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your User Content; or (c) your violation of these Terms or any applicable law or third–party right.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services (including specific events) at any time if we reasonably believe you have violated these Terms, are misusing the Services, or if necessary to protect the Services or other users.

Sections that by their nature should survive termination (including those related to intellectual property, User Content licenses, disclaimers, limitations of liability, and indemnification) will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will take reasonable steps to notify you, such as by posting a notice in the app or on the website. Your continued use of the Services after any changes become effective means you agree to the revised Terms.
